Point of dispute: public sector customer rejected to accept works executed under the public contract and constantly complained about the poor quality of works. Due to delay in performance of works, the public sector customer filed a claim to collect a forfeit for the violation of period for obligations fulfillment.

Legal Business Solution’s lawyers managed to prove the fact of the acceptance of works irrespective of signing of the Handover Certificate, and to determine the fact of violation of the customer’s obligations. In this regard, the parties decided to enter into a voluntary settlement agreement approved by the Arbitration Court of Krasnodar Region with the support of our lawyers.

By entering into a voluntary settlement agreement with the public sector customer, Rostelecom JSC escaped penalties and termination of the contract, and received funds for its works executed under the public contract.
